REGULATIONS (REGISTRATION SYSTEM FOR SCOREAPP COMPETITIONS)

The regulations of the ScoreApp registration system for sports competitions define the principles of operation of the website, available at scoreapp.mywaypds.pl and run and managed by the MY WAY Foundation.

§ 1

GENERAL INFORMATION

The ScoreApp registration system for sports competitions (hereinafter referred to as the ScoreApp Service) is available at scoreapp.mywaypds.pl and is run and managed by the MY WAY Foundation, ul. Stefana Czarnieckiego 45, 25-136 Kielce, NIP 9592057894, REGON 52397330900000, KRS 0001008502.

The provisions of these Regulations, together with the provisions of law in force in the territory of the Republic of Poland, exclusively determine the principles of operation of the ScoreApp Website, the rights and obligations of the Website Users, as well as the rights, obligations and scope of liability of the Administrator/Service Provider.

Each User is obliged, upon taking steps to use the ScoreApp Website, to comply with the provisions of these Regulations.

Before Registering in the ScoreApp System, please read the provisions of these Regulations.

§ 2

DEFINITIONS

Regulations – these Regulations for the provision of services on the ScoreApp Website.

Website – registration and registration system for ScoreApp competitions.

Administrator/Service Provider – MY WAY Foundation, ul. Stefana Czarnieckiego 45, 25-136 Kielce, NIP 9592057894, REGON 52397330900000, KRS 0001008502.

User – a natural person or entity using the services offered by the ScoreApp Website; every person visiting the Website.

Registration form - a form available on the ScoreApp Website under the "Register!" panel, enabling the creation of a User Account.

Registered User - means a natural person who has successfully registered on the ScoreApp Website by clicking on the registration panel "Register!", providing the data needed for registration (name, surname, date of birth, country, e-mail) and a password of their choice allowing to log in to the ScoreApp website.

User Profile - a set of information describing and identifying a given Registered User of the Website, transferred independently and voluntarily by the Registered User to the Website, which is processed and published on the Website in accordance with the Personal Data Protection Act, also enabling registration for competitions and providing access to the results and User's payments.

User Account - Electronic Service, marked with an individual name (login) and password provided by the User, a set of resources in the Service Provider's IT system in which the User's data is collected, including information on registration for sports competitions, information on results and payments.

Electronic registration for Sports Competitions/Registration Form - forms available via a web browser available on the ScoreApp Website, personalized according to the Profile data and the requirements of the competition organizer, enabling registration for Sports Competitions.

Electronic service – services provided electronically by the Service Provider to the User, available on the ScoreApp Website.

Sports competitions - Pole Dance sports competitions organized by the Service Provider, i.e. by the MY WAY Foundation.

Force majeure - any sudden external events resulting in the objective impossibility of providing services covered by the Regulations, which the Administrator was unable to predict.

Working day - one day from Monday to Friday, excluding public holidays.

Civil Code - Act of April 23, 1964 (Journal of Laws 1964, No. 16, item 93)

§ 3

GENERAL PROVISIONS

These Regulations are addressed to Users using the ScoreApp competition registration and registration system.

The administrator of personal data processed in connection with the implementation of the provisions of these Regulations is the ScoreApp Service Provider. Personal data is processed for the purposes, within the scope and based on the principles indicated in the privacy policy published in the part of the Regulations entitled "PRIVACY POLICY", which constitutes an integral part of these Regulations.

By registering and signing up for sports competitions on the ScoreApp Website, the User declares that he or she has read these Regulations and accepts their terms and provisions. If the User fails to comply with the provisions of these Regulations, the ScoreApp Website Administrator is entitled to refuse to accept the subscription.

 

§ 4

GENERAL CONDITIONS AND RULES OF USE OF THE WEBSITE

To use the services of the ScoreApp Website, you must have a device that allows you to use the Internet, a web browser with cookies enabled, and an e-mail box.

The basic purpose of the ScoreApp website functioning on the Internet is:

enabling Registered Users to register electronically for sports competitions organized by the ScoreApp Service Provider,

enabling access to the results of Registered Users participating in sports competitions,

enabling payments for entry to sports competitions,

publication of results from sports competitions prepared and organized by the Service Provider.

Registration on the ScoreApp website is voluntary and free of charge.

Creating a User Account (by registering on the ScoreApp Website) is necessary to register the ScoreApp Website User for sports competitions and to pay for the competition and view the results.

Registered Users are obliged to update the data saved in the User Profile whenever they change, in particular if these changes have a significant impact on participation in sports competitions. All consequences of providing false data are borne by the User.

The Administrator of the ScoreApp Website reserves the right to introduce new functionalities and services available on the ScoreApp Website, conduct and cancel all types of promotional campaigns, and carry out maintenance work on the Website, including temporarily disabling some or all of the functionality of the Website.

§ 5

ELECTRONIC SERVICES AVAILABLE ON THE SCOREAPP WEBSITE

The following Electronic Services are available on the ScoreApp Website:

Registration form for the ScoreApp website,

User's account,

Registration form for sports competitions,

User Account password reminder,

Possibility to register via Facebook.

Using the User Account is possible after completing the following activities: completing the Registration Form by clicking the "Register!" field; confirming your intention to create an Account by clicking on the confirmation link sent to the provided e-mail address. In the Registration Form, it is necessary to provide the following data of the Service User: name and surname, e-mail address, date of birth, password.

The Registration Form enables the User to sign up for the Sports Competition by submitting the registration form after clicking the "participate" field and completing the Registration Form.

§ 6

FEES AND PAYMENT METHODS

Registration on the ScoreApp website is free.

Participation in sports competitions organized by the Service Provider is subject to payment.

The service provider provides online payments. Payments for the competition can be made via the automatic online payment system operated by the Paynow system (mBank payment gateway).

§ 7

COMPLAINTS

If the User finds irregularities in the registration process, in the process of registering for a Sports Competition, in the payment process (subject to point 4 of this paragraph) or in the form of any incorrect operation of the ScoreApp Website, the User may submit a complaint.

A complaint should be submitted by sending a message to the e-mail address of the Service Provider, i.e. scoreapp@mywaypds.pl.

Complaints will be considered by the Service Provider within 14 days from the date of receipt of the notification.

Complaints regarding the payment of fees for sports competitions should be submitted directly to the online payment operator.

§ 8

FINAL PROVISIONS

The Service Provider reserves the right to make changes to the Regulations for important reasons, i.e. changes in legal provisions, changes in payment methods, changes in the scope of payment or the form of Electronic Services provided. In such a case, the updated version of these Terms and Conditions will remain in this location.

Changes to the Regulations will not in any way violate the rights acquired by Users who are also consumers and use the ScoreApp Website before the date of entry into force of the changes, in particular, changes to the Regulations will not affect already registered Users.

In matters not regulated in these Regulations, the following provisions apply:
- Civil Code,

- Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204),

- Act of July 27, 2002 on special conditions of consumer sales and amending the Civil Code (Journal of Laws of 2002, No. 141, item 1176)

- other relevant provisions of Polish law.

In the event of disputes with the User of the ScoreApp Website, the court competent to hear them is the common court with local and material jurisdiction over the Service Provider.
